These Terms of Use (“Terms”) govern your access to and use of the Infinite Loop website, newsletter, and any related content or features made available at https://infiniteloop.media (collectively, the “Service”). The Service is operated by Nebius B.V., a private limited liability company organized and existing under the laws of the Netherlands, with its registered office at Schiphol Boulevard 195, 1118 BG Schiphol, the Netherlands, registered with the Dutch Trade Register (KvK) under number 87416350 (“Nebius”, “we”, “us”, “our”).
By accessing or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.
1. Scope and Nature of the Service
The Service provides editorial content, commentary, updates, and other informational materials published by Nebius, including newsletters, articles, media, and related communications. The Service is provided for general information purposes only and does not constitute legal, financial, investment, or other professional advice. You should not rely on the Content (as defined below) as a substitute for professional advice specific to your circumstances.
2. Eligibility; Accounts and Subscriptions
The Service is intended for users who are at least 16 years old. If you are under the age of majority in your country of residence (18 in the Netherlands), you may only use the Service with the consent and under the supervision of a parent or legal guardian, and your parent or guardian is responsible for your use of the Service.
Access to most of the Service does not require an account. If you subscribe to our newsletter or if we make user accounts available, you must provide accurate, current, and complete information and keep it updated. You are responsible for all activity under your subscription or account and for maintaining the security of your access credentials. You must promptly notify us of any suspected unauthorized use or security breach.
We may refuse, suspend, or terminate a subscription or account (if applicable) if you violate these Terms or to protect the integrity, security, or availability of the Service.
3. Intellectual Property; Use of Content
All content available through the Service, including text, graphics, images, logos, video, editorial materials, designs, and the Service’s look and feel (collectively, “Content”) is owned by or licensed to Nebius and protected by applicable intellectual property and other laws. Except as expressly permitted by these Terms or applicable mandatory law, all rights are reserved.
You may:
Access and read the Content for your personal, non-commercial use; and
Share links to pages of the Service and quote insubstantial excerpts of articles consistent with fair use/fair dealing and applicable exceptions.
You may not, without our prior written permission:
Reproduce, distribute, publicly display, perform, publish, or create derivative works from the Content.
Resell, license, or otherwise commercially exploit the Content.
Scrape, harvest, or systematically collect data from the Service, including via automated tools (such as crawlers, bots, or scrapers) except as permitted by a publicly documented robots.txt and solely for non-commercial indexing.
Use the Content or any portion of the Service to train or improve machine learning or artificial intelligence models.
Remove, alter, or obscure any proprietary notices on or in the Service or Content.
Any permissible use must retain all copyright, trademark, and attribution notices. Nothing in these Terms grants you any license to our trademarks, logos, or brand features.
4. User Submissions and Conduct
If interactive features (such as comments or feedback forms) are made available, you must ensure that any content you submit (“User Content”) is lawful, accurate, and does not infringe any third-party rights. You must not upload or transmit any material that is unlawful, defamatory, obscene, hateful, harassing, deceptive, invasive of privacy, or otherwise objectionable, or that contains malware or other harmful code.
By submitting User Content, you grant Nebius a non-exclusive, royalty-free, worldwide license to host, store, reproduce, and display such User Content solely for the purpose of operating, improving, and presenting the Service. You represent and warrant that you own or have all necessary rights to your User Content and that its use by Nebius under this clause will not infringe any third-party rights.
We may remove User Content and/or suspend or terminate access to the Service for any violation of these Terms or where required by law.
5. Third-Party Services
We use third-party service providers, including Beehiiv, to support certain functionalities of the Service, such as newsletter distribution, hosting, analytics, and operational support. Your use of features enabled by such providers may be subject to their terms and policies. Nebius is not responsible for third-party services, their content, or their policies, and your relationship with such providers is solely between you and them.
Links to third-party sites or resources are provided for convenience only and do not constitute an endorsement. We have no control over and are not responsible for third-party content or availability.
6. Privacy
Nebius processes personal data in accordance with its Privacy Notice available at The Privacy Notice describes what personal data we collect, our purposes and legal bases for processing, how long we retain data, and your rights under applicable data protection laws including the GDPR. Beehiiv and other vendors act as processors/service providers for Nebius, processing personal data on our behalf subject to appropriate data protection terms. Where you engage directly with a third party, their privacy terms may also apply.
7. Disclaimers
The Service and Content are provided “as is” and “as available.” To the maximum extent permitted by applicable law, Nebius disclaims all warranties, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Content is accurate, complete, or current. You are solely responsible for your use of the Service and any reliance on the Content.
Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under applicable law.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
Nebius will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any lost profits, lost data, or business interruption, arising from or related to your use of the Service or Content, even if advised of the possibility of such damages.
Nebius’s aggregate liability for all claims arising out of or relating to the Service or these Terms shall not exceed EUR 100.
The above limitations do not apply to liability that cannot be limited or excluded under Dutch law, including liability for death or personal injury caused by negligence, or for wilful misconduct or gross negligence. If you are a consumer, you may have mandatory rights under applicable consumer law that prevail over any conflicting limitation in these Terms.
9. Intellectual Property Complaints
If you believe that any Content infringes your intellectual property rights, please contact [email protected] with sufficient details for us to identify and locate the material, describe your rights, and verify your authorization to act. We will review and respond as appropriate under applicable law.
10. Changes to the Service or Terms
We may update, enhance, or modify the Service at any time. We may also revise these Terms from time to time. The “Last updated” date indicates the effective date of the current version. Changes will apply from the date posted. If we make material changes, we will take reasonable steps to notify newsletter subscribers (for example, by email) or by prominent notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
11. Suspension and Termination
We may suspend or terminate your access to the Service (including subscriptions or accounts, if applicable) at any time, including to protect the integrity, security, or availability of the Service, or if you breach these Terms. Upon termination, the rights granted to you under these Terms will cease immediately. Sections that by their nature should survive (including Sections 3, 4, 7, 8, 9, 12, and 13) will continue to apply.
12. Applicable Law; Jurisdiction; Consumers
These Terms and any non-contractual obligations arising out of or related to them are governed by the laws of the Netherlands, without regard to conflict-of-law principles. The competent courts of Amsterdam, the Netherlands, have exclusive jurisdiction over any disputes arising from or relating to these Terms or the Service.
If you are a consumer habitually resident in the EU/EEA or the UK, you may bring proceedings in the courts of your country of residence where required by applicable consumer protection law, and nothing in these Terms limits any rights you have to do so. EU/EEA consumers may use the European Commission’s Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr/.
13. Communications; Electronic Notices
By using the Service, you agree that we may communicate with you electronically, including by email. For newsletter subscribers, you can unsubscribe at any time via the link in our emails. Formal notices to Nebius must be sent to the contact details below.
14. Miscellaneous
These Terms constitute the entire agreement between you and Nebius regarding the Service and supersede any prior understandings on the same subject. We may assign or transfer our rights and obligations under these Terms; you may not assign these Terms without our prior written consent. If any provision is held invalid or unenforceable, it will be replaced with a valid provision that most closely reflects the intent, and the remainder will remain in full force. No failure or delay to enforce any right will be deemed a waiver. Nothing in these Terms creates an agency, partnership, or employment relationship.
